My builder has produced poor quality work. He has tried 3 times to rectify it, but it is still poor. We are now refusing to pay him the final balance and want to use the money to get someone else in to rectify his work. He is threatening legal action due to breach of contract. Please advise.

To my knowledge,you should be able to get three seperate quotes,and choose the most reasonable one,and then deduct this amount from what you owe the original builder.I dont know what contract you have signed so this may not be applicable,but this would be the normal procedure.regards graham

It's all about what's reasonable ! He has tried to rectify the problem three times , which is a good effort on his part and scores him some legal points . You have been very reasonable and allowed him three opportunities to rectify the poor workmanship which scores you some legal points ! In the end , he has displayed , though willing, the inability to complete the job to a reasonable standard , you have every right to seek an other contractor to complete the work . Get two quotes, offer him to choose who will do the work , if the cost is higher than the outstanding money , offer to pay the difference . Then you're covered .
