Who is responsible?

Hi, Due to leak coming from upstairs flat, our builder had to take out part of ceiling to locate source of leak. He then said two joists need replacing (not because of the leak, just that they weren't suitable ones.) I was wondering who is responsible for joists on the ceiling. Us or the owners of the flat above? Please help! Thank you, Kay

Hi Kay in what way did the builder say the joists were unsuitable? I am presuming your flat is leasehold and that you pay a monthly or annual maintenance fee, this money is normally used to maintain the fabric of the building. Contact the freeholder or their agent to see if the repairs to the joists are covered do not complete any work until they have had chance to view it as you are unlikely to be reimbursed, you should not have to cover the cost yourself.
