Building regs for existing property (kitchen ventilation)

Hello,
I understand extractor fans are required by law for new builds, but in Scottish law, do you also need it for kitchen refits?
In English law you only need the ventilation to not be made worse by the refit, but Edinburgh council have told me we need a fan now the wall has been removed to make it open plan. Seems strange to me!
