Patio, drainage and damp course

Just had a patio laid but it doesn't look right. I was told I needed drainage as the slabs are very close to damp course; should they had put the slabs lower? They also said I needed the damp course re done. They have put mortar there which bridges the bricks. I've been told by a friend that this is wrong as the mortar should not cover the damp course membrane, is this right? One area of the drainage channel I was told by friend is pointless because any rain water collected in it has no where to go. I was charged a £1000 to put the drainage in and mortar the damp course on front and back of small semi. They also left a fair amount of sand in the drainage channel, should they have cleaned it out. I have been told this would stop the flow if water. Any advice, thoughts welcome.
