Wooden floor

I have had a wooden floor laid by a professional fitter. It started lifting and an inspector was sent by the floor manufacturer. They sent this in the report. What should my next steps be? Who was at fault myself or the fitter? The floor wS screeded 2 months before the floor was fitted. 1. The underlay was put down the wrong way therefore allowing moisture through and the floor has expanded 2. The floor wasn't left in the room before being fitted and hadn't had the chance to acclimatise The floor needs replacing. Who should pay for the new floor and fitting costs? Thank you
