Toilet leak causing wet walls

After removing tiles we discovered faulty pipe leaking into wall / old age toilet cistern need to be replaced and wet wall replastered - is this normally covered by building insurance (freeholder says no as I'm only the leaseholder) appreciate any advise.

Cost of repairs would normally be covered under building insurance, but this is likely to cost less than the excess on the plan as the toilet and fixing the pipe would not be covered. So they would look at a patch plaster and painting of the affected wall only would be what is likely to be covered.
