Do I have to pay half the cost for work done to capped shared chimney?

Hi, we share a capped chimney with our neighbour (was removed some time ago and now only has a height of 3 bricks above the roof) which would not have been used for many, many years. Neighbour has a leak in the third bedroom but we do not. They want us to fund half the cost of either re-capping or removing the remaining stack. Are we legally bound to fund half of this? Or can we say that as our third bedroom is unaffected, the cost should be theirs? Thanks in advance!
