Damp patch and depth of damp proofing holes

Since refurbishing the kitchen six months ago which included some damp proofing work, there has been a damp patch about a foot square on an internal wall just above the skirting (previously external brick wall before an extension prior to us moving in). The damp proofer blames the plasterer for breaching the damp proof course but when I took the skirting away and explored the situation I noticed the drilled holes for the damp proofing are 'empty' (proded them with some dowell) to a depth of approx. 10cm. Research on DIY websites suggests they should have been drilled to that depth before being filled so since I think they are empty, has my damp proofer forgotten to fill those holes, therefore letting the damp through?
